This agreement describes the entire terms and conditions for participation in the TomeyMarketing.com Affiliate Program.

Affiliate Link
We will create a unique linking code for you when you submit and have approved a complete Affiliate Application.

Commissions
You will receive 50% of the revenue generated from completed orders placed through your web site or ezine. Unless stated otherwise.

Payment
We do not pay our affiliates through PayPal.com We have had several problems with PayPal.com and paying our affiliates (see http://www.JustSayNoToPayPal.com for more information) that we now pay all of our affiliates by check at the 1st of the month.

Example: Anything sold between March 1st and April 1st would be paid on May 1st. There is a 30 day waiting period because all of our products come with a 30 day guarantee.

Order Fulfillment
We reserve the right to reject any order that does not comply with our operating procedures and policies.

Qualifications for Commissions
Affiliates must have an active link from their website or ezine to qualify for commissions.

Unsolicited Commercial Email
About SPAM. TomeyMarketing.com does not support spam. Promoting your partner website through unsolicited emails of any type, unauthorised newsgroup postings, message board posts or any other method of transmission that is of an unsolicited nature will not be tolerated. Here are the rules.
Any member caught spamming will:

* Have their account terminated immediately.
* Be banned from our website.
* Be reported to the appropriate authorities for further actions.
* Any due commission will be withheld.

Relationship of Parties
TomeyMarketing.com and the affiliate are independent contractors and nothing in this Agreement should be construed to imply partnership, franchise or an employment relationship between the parties.

Limitation of Liability
We are not liable for indirect, special, or consequential damages (or any loss of revenue) arising in connection with this Agreement. Further our aggregate liability arising with respect to this Agreement will not exceed the total commissions paid or payable to the Affiliate under this Agreement.

TomeyMarketing.com makes no express or implied warranties or representations with respect to the Affiliate Program or the Affiliate's potential to earn income from the Affiliate Program.

The laws of the United States and Tennessee will govern this Agreement, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Tennessee and the Affiliate irrevocably consents to the jurisdiction of such courts. The Affiliate may not assign this Agreement without the prior written consent of TomeyMarketing.com.

By submitting the Affiliate Application Form, you acknowledge that you have read this agreement and agree to all its terms and conditions.
